FUE Communication of commencement and substantial modification of activity in an establishment with technical certificate (CPCT)

By means of prior communication with a Technical Certificate, the interested party informs the competent public administration of the start/modification of an economic activity.

What is this procedure?

Through prior communication with a Technical Certificate, the interested party informs the competent public administration of the start of an economic activity, which requires the presentation of a technical certificate according to the annex to Law 18/2020, of December 28, on the facilitation of economic activity.

The communication of data for the start of the activity in an establishment immediately enables the exercise of the activity under the responsibility of the owner and the competent technician who signs the technical documentation. The communication of the data empowers the Administration to carry out any verification action.

Failure to pay the fees relating to the economic activity before it begins will render the communication ineffective.

The communication must be formalized once the necessary works and installations have been completed, which must be covered by the corresponding urban planning license, or, where applicable, by prior communication of works not subject to a license and also for the rest of the necessary sectoral licenses.

Who can apply for it?

The legal person who wishes to carry out one or more activities in a single centre or establishment or its legal representative. In this case, the representation with which it acts must be declared.

The activities subject to the Prior Communication regime with technical certificate are those included in the annex (see column corresponding to "technical certificate"), of Law 18/2020, of December 28, on the facilitation of economic activity: Annex Law 18/2020

What documentation must be submitted?

  • Certificate from the competent technician, who is responsible for the commissioning of the activity, in accordance with the standard model (LLA-020). (In the event that the technical certificate is not endorsed, it will be necessary to provide proof that the technician has a valid professional civil liability policy.) .  The certificate must be accompanied by a location plan of the establishment and floor and section plans.
  • Responsible declaration in matters of food health if it is an establishment affected by Royal Decree 191/2011, of February 18, on the general health register of food companies and foods, if applicable.
  • Authorization for the discharge of wastewater when wastewater is discharged into the municipal sewer, if applicable, according to article 22.1 of the Wastewater Discharge Regulation, published in the BOPB of 12/12/2018.
  • Sound insulation or immission control measure of blinds carried out by the Noise Pollution Prevention Entity (EPCA), when applicable according to the Ordinance regulating noise and vibration pollution.


    How much does it cost?

    This procedure is not free.

    The self-assessment of taxes must be requested from the Tax Management Department, prior to the presentation of the documentation, and payment must be made once the payment letter has been received. The receipt accrediting the settlement of the taxes will be included with the rest of the documentation that must be attached to formalize the procedure.     Failure to pay the fees relating to the economic activity before it begins will result in the declaration or communication being rendered ineffective, in accordance with the verification procedure established in article 42 of Law 18/2020, of December 28, on the facilitation of economic activity.

    Observations

    1. PREREQUISITES

    • Activities that, according to their needs, require the entry of vehicles inside the establishment must process the corresponding ford license application.
    • If it is an activity that you want to locate in existing buildings built without a specific use, you must provide an urban compatibility report.
    • If the activity requires the installation of any INFORMATION SIGN, the corresponding municipal permit must be requested from the Department of Works and the sign must follow the parameters set in the Static Advertising Ordinance approved on February 6, 2002.
    • In accordance with article 32.6 of Law 18/2020, the communication of the start of activity can only be submitted once the previous interventions established by the sectoral regulations have been successfully completed. This implies that, if renovation works are required to implement the activity, the corresponding urban development title (license or communication of works) must have been previously obtained and executed. The communication of activity must be formalized once the premises are fully suitable and have all the required prior permits.

    Ban on flag signs: except hotels, car parks, pharmacies or credit institution ATMs. If the establishment already has a flag sign, it must be removed.


    2. INFORMATION NOTE RELATING TO ESTABLISHMENTS INTENDED FOR TEMPORARY ACCOMMODATION

    By means of the Modification of the General Metropolitan Plan definitively approved on July 16, 2019 (DOGC 22.07.2019), the conditions for the implementation of tourist housing and establishments intended for temporary accommodation in the form of hostels or boarding houses, tourist apartments, youth hostels and student residences have been regulated, in the municipal area of ​​El Prat de Llobregat. Currently, and until the planning is adapted to the conditions indicated in Decree-Law 3/2023, of November 7, on urgent measures on the urban planning regime of tourist housing, new tourist housing cannot be authorized.

    For tourist accommodations and other short-term accommodations established in CCAE I 552, the habitability certificate is equivalent to the supporting technical certificate in the terms established in article 32.1 of Law 18/2020 on the facilitation of economic activity.

    3. INFORMATION NOTE REGARDING ACCESSIBILITY

    Applications submitted from 01/09/2024 must comply with Decree 209/2023, which approves the Accessibility Code of Catalonia.

    4. NOTE REGARDING THE SIGNATURE OF PROJECTS AND TECHNICAL CERTIFICATES

    They must be signed by a competent technician, and the technician's liability policy must be provided in the case of certificates or projects not approved by a professional association.


    5. OTHERS

    Once the documentation submission process has been completed, the interested person will be able to begin carrying out the activity, always under their own responsibility.

    The City Council reserves the powers of inspection and control over the activities subject to this regime.
