FUE Prior municipal environmental communication (Annex III) (CPA)

Through the prior municipal environmental communication, the interested party informs the competent public administration of the start of an economic activity.

What is this procedure?

Through the prior municipal environmental communication, the interested party informs the competent public administration of the start of a low-risk activity of those included in Annex III of Law 20/2009, of December 4, on environmental prevention and control of activities (hereinafter LPCAA) and others derived from the municipal Ordinance, and accompanies the project and technical certificate necessary for its exercise.

Prior communication allows an activity to be initiated from the day of submission and empowers the corresponding public administration to verify the conformity of the data contained. Communication of the data empowers the Administration to carry out any verification action.

The communication must be formalized once the necessary works and installations have been completed, which must be covered by the corresponding urban planning license, or, where applicable, by prior communication of works not subject to a license and also for the rest of the necessary sectoral licenses.

Who can apply for it?

The legal person who wishes to carry out one or more activities in a single centre or establishment or its legal representative. In this case, the representation with which it acts must be declared.

The activities subject to the municipal prior environmental communication regime are the following:

A. Activities included in Annex III of Law 20/2009, of December 4, on prevention and environmental control of activities (hereinafter LPCAA).

B. Activities consisting of temporary mobile technical units associated with public or private infrastructure works, waste treatment activities, or similar facilities in Annex II of the LPCAA provided that, as independent activities and due to their characteristics, they are not associated with a fixed location, nor do they have the condition of stable activities.

C. Activities with an environmental impact and/or on the safety of people that cannot be classified in any of the other processing regimes provided for in the Municipal Environmental, Safety and Public Health Ordinance, or in the Municipal Intervention Ordinance in Public Places, Public Shows and Recreational Activities.

What documentation must be submitted?

  • Technical certificate according to the City Council's standard model (Model LLA-003). Replaceable with another certificate model. In any case, the final certificate must always state that "The activity conforms to the project presented, that all industrial safety requirements, risk prevention and other mandatory requirements are met, in accordance with applicable legislation and that all mandatory authorizations are available to carry out the activity"
  • Basic project and/or environmental report.
  • Specific environmental certifications established in the ordinance for those cases where the activity generates emissions of gases or fumes, noise or vibrations, outdoor lights at night, contaminated water and/or non-assimilable waste. These specific certifications may be issued by a collaborating entity of the Administration or by municipal technicians.
  • Environmental impact statement, if applicable.
  • Report of in-situ acoustic measurements carried out by an Environmental Prevention and Control Entity (EPCA) that certifies the minimum airborne noise insulation values ​​DnT, A, and/or compliance with the operating limit values ​​of rolling metal shutters indicated in Annex 4 of the Ordinance Regulating Noise and Vibration Pollution, if applicable.
  • Certification of the favorable verification act in matters of fire when it comes to activities included in annexes 1 or 2 of Law 3/2010, of February 18, on prevention and safety in matters of fire in establishments, activities, infrastructures and buildings, or if it is in a case included in article 11.1.c) of Royal Decree 164/2025, of March 4, by which the Fire Safety Regulation in Industrial Establishments is approved.
  • Livestock manure plan, in the case of livestock activities with the consequent favorable report issued by the competent Department for agriculture and livestock, if applicable.
  • Authorization for the discharge of wastewater into the public waterway or the sea, where applicable.
  • Accessibility sheet in accordance with the provisions of article 122 of the Accessibility Code of Catalonia (DECRET 209/2023, of November 28, which approves the Accessibility Code of Catalonia), where applicable.
  • Responsible declaration in matters of food health if it is an establishment affected by Royal Decree 191/2011, of February 18, on the general health register of food companies and foods, if applicable.

How much does it cost?

This procedure is not free.

The self-assessment of taxes must be requested from the Tax Management Department, prior to the presentation of the documentation, and payment must be made once the payment letter has been received. The receipt accrediting the settlement of the taxes will be included with the rest of the documentation that must be attached to formalize the procedure. The request for taxes will be made through the procedure "TXIA - Interventions in Activities: Payment Letter", which can be accessed via the link at the bottom of the page" 

Failure to pay the fees relating to the economic activity before it begins will result in the declaration or communication being rendered ineffective, in accordance with the verification procedure established in article 42 of Law 18/2020, of December 28, on the facilitation of economic activity.

Observations

1. PREREQUISITES

  • Activities that, according to their needs, require the entry of vehicles inside the establishment must have the Decree granting a ford license granted by the City Council at the time of submitting the prior communication.
  • If it is an activity that you want to locate in existing buildings built without a specific use, you must provide an urban compatibility report.
  • If the activity requires the installation of any INFORMATION SIGN, the corresponding municipal permit must be requested from the Department of Works and the sign must follow the parameters set in the Static Advertising Ordinance approved on February 6, 2002.
  • In the event that the activity to be carried out is considered to be of significant risk in terms of fires, as provided for in Law 3/2010, of February 18, on prevention and safety in matters of fires in establishments, activities, infrastructures and buildings, or is included in section 11.1.c of Royal Decree 164/2025, of March 4, which approves the Regulation on fire safety in industrial establishments, prior to making the communication it is necessary to have the corresponding certificate of favorable verification in matters of fires.

Prohibition of flag signs: except for hotels, parking lots, pharmacies or credit institution ATMs. If the establishment already has a flag sign, it must be removed.

To carry out the activity, it will be necessary to carry out the appropriate reforms in terms of accessibility according to the applicable regulations in force at all times.

2. INFORMATION REGARDING ACCESSIBILITY

Applications submitted from 01/09/2024 must comply with Decree 209/2023, which approves the Accessibility Code of Catalonia.

3. NOTE REGARDING THE SIGNATURE OF PROJECTS AND TECHNICAL CERTIFICATES

They must be signed by a competent technician, and the technician's liability policy must be provided in the case of certificates or projects not approved by a professional association.


4. OTHERS

Once the documentation submission process has been completed, the interested person will be able to begin carrying out the activity, always under their own responsibility.

The City Council reserves the powers of inspection and control over the activities subject to this regime.
