What is this procedure?

Application for recognition of the situation of dependency and access to the benefits included in Law 39/2006, of December 14, on the Promotion of Personal Autonomy and Care for People in a Situation of Dependence.

Dependency is a permanent state in which people find themselves who, for reasons arising from age, illness or disability and related to the lack or loss of physical, mental, intellectual or sensory autonomy, need the attention of another person or significant assistance to carry out basic daily activities.

In case of disagreement with the grade and level awarded by the assessment report, the interested person may file a claim within 30 days from the date of notification of the resolution. An updated medical report that complements those previously delivered for the assessment carried out and other evidence that is considered relevant must be attached to the claim.

Who can apply for it?

People who are in a situation of dependency who reside in Spanish territory and have done so for 5 years, two of which must be immediately prior to the date of submission of the application. For children under 5 years of age, the period of residence will be required of the person who has custody and guardianship.

What documentation must be submitted?

  • Information and collection of applications at the Social Services First Aid Unit (UPASS). If the person is admitted to a residential center or health partner, they must contact the management or the Social Work Service of the center itself.
Personal and administrative data:
  • Certificate of registration proving five years of residence in Spanish territory, two of which must be immediately prior to the date of submission of this application. In the event that the applicant is under five years of age, the supporting documentation will be that of the person who has custody and guardianship.
  • Judicial resolution, in case of incapacity, or notarial power of attorney proving legal representation, if applicable.
  • NIF or NIE of the person in a situation of dependency.
  • Photocopy of the NIF or NIE of the legal representative or the NIF of the titular entity, if applicable.
Health data:
  • Original health report from a doctor from the public health network, with a maximum date of two years prior to the date of the application and stating the diagnoses linked to the dependency.
Specific documentation:
  • In case of permanent disability with a degree of great disability: notification of the revaluation of the pension for the current year or photocopy of the certificate from the National Institute of Social Security (INSS) of the situation of permanent disability with a degree of great disability.
  • In case the person with a disability has been assessed outside Catalonia: certificate of the person with a disability and a scale of need from a third person.
  • In the event that the person is a returned emigrant: the resolution recognizing the returned emigrant and supporting documentation of the person who is covered by other countries.
