Minor work - Prior communication with provision of technical documentation

This procedure allows you to carry out works included in the typology of works subject to prior notification (article 187 bis of the Urban Planning Law, approved by Legislative Decree 1/2010, in accordance with the modification introduced by Law 16/2015, of July 21, on the simplification of the administrative activity of the Administration of the Generalitat and the local governments of Catalonia and the promotion of economic activity).

By submitting the prior communication accompanied by the corresponding technical documentation or technical project, the interested person informs the City Council of the facts and necessary documentation prior to the start or modification of all those urban planning works and actions susceptible to municipal control.

If the communication does not meet the requirements required by the regulations, the City Council will warn the interested party that until the communication and the mandatory documentation are submitted, the communicated works cannot be executed.

The following acts are subject to prior notification, with the exceptions established in articles 187.2 and 187 ter:

a) New constructions and installations and works for the expansion, reform, modification, rehabilitation or total or partial demolition of existing constructions and installations that, in accordance with the legislation on building planning, do not require the preparation of a technical project (new works of little constructive entity; works that do not involve alteration of the composition of the building, or of volume or of the entire structural system; or of change of use, or that affect listed buildings) nor do they occupy a public road for their execution.

b) The first use and occupation of the buildings.

c) Change of use of buildings and facilities, except residential use.

d) The construction or installation of walls and fences.

e) The placement of posters and advertising hoardings visible from the public road.

f) The formalization of legal operations that, without constituting or modifying a horizontal property regime, simple or complex, involve an increase in the number of homes, establishments or other elements susceptible to independent private use with respect to those authorized in a previous urban planning license.

g) Acts subject to intervention that are carried out on non-developable and undefined developable land and that are covered by a specific action project or an urban plan that organizes the affected land in the same detail, provided that they do not require the preparation of a technical project in accordance with the legislation on building planning.

h) The installation of photovoltaic panels with a height not exceeding 1m in accordance with the ordinance. Consult the Ordinance at:Ordinance for the promotion of self-consumption installations with photovoltaic energy in the municipality of El Prat de Llobregat

If the communication does not meet the requirements required by the regulations, the City Council will warn the interested party that until the communication and the mandatory documentation are submitted, the communicated works cannot be executed.

For information purposes and among others, the following works are subject to prior notification:

- Renovation of homes or premises that require demolition or modifications to distributions.
- Renovation of facades and buildings that DO NOT require the installation of scaffolding or other impacts on public roads.
- Renovation of lobbies in community staircases.
- Renovation of roofs and building covers.
- Reform and adaptation of industrial buildings.
- Installations of signs and awnings that are NOT LOCATED ON THE ROOF OF THE BUILDING (OBSERVATIONS: THE INSTALLATION OF FLAG SIGNS IS PROHIBITED)
- First use and occupation of buildings.
- Reforms and adaptations of industrial buildings.

Documentation to provide:

Standardized model for prior communication of works.

Location plan that precisely identifies the property affected by the works.

Technical report describing and justifying the works to be carried out.

Detailed budget for the works.

Plans, dimensioned and at an appropriate scale, where the works are graphically represented according to their characteristics.

Chromatic study according to the Ordinance regulating the use of colors, materials and other elements in buildings.

Form of assumption of the optional management of the work, issued by an architect or surveyor and endorsed by the corresponding official Association.

Sworn declaration of the contractor.

Color photographs of the current state, if applicable.

Basic health and safety study, if applicable.

NIF or CIF of the applicant.

Legal entity: Deed of incorporation and NIF of the company, as well as the powers of the representatives and NIF of the same.

If it affects common structural elements of the building, authorization from the Community for the works to be executed or accreditation of compliance with art. 128 of the Metropolitan Building Ordinances

Form of assumption of the optional management of the work, issued by an architect or surveyor and endorsed by the corresponding official Association.
