What is this procedure?

The prior report on fire prevention must be requested, as established in Law 3/2010, of February 18, on fire prevention and safety in establishments, activities, infrastructures and buildings, when the activity is considered to be of significant risk in terms of fire:

1) Activities included in annexes 1 or 2 of the aforementioned law.

2) Activities that are of a sporadic or one-off nature, in accordance with article 23 of the aforementioned law.

After obtaining the favorable report, it will be necessary to carry out the fire inspection and proceed to make the corresponding prior communication.

Who can apply for it?

The legal person who wants to carry out one or more activities in the same center or establishment, or in its legal representative. In this case, the representation in which it acts must be declared.

What documentation must be submitted?

Documentation to provide:

Request for prior fire report (INC)

Cover of the technical documentation (form SP01 of the Department of the Interior of the Generalitat de Catalunya)

Technical project describing and justifying compliance with the applicable technical regulations on fire (1 copy on paper and 1 copy on digital media) drawn up by the competent technician.

If acting as a legal representative, declare that you have all the necessary powers to submit the communication and receive, if applicable, the corresponding communications and/or notifications.


How much does it cost?

This procedure is free.

Observations

CHANGE IN THE PROCESSING OF THE PREVENTIVE REPORT ON FIRE.

Since March 1, 2024, there has been a modification in relation to the way in which the preventive report on fires was requested until then.
From now on, the prior report on fire prevention will be requested following one of the following two alternatives, as the case may be:

Case 1: Request for a prior report on fires through the Business Channel

This will be done in one of the following two cases:

a) When the owner of the activity is a private individual and the activity is classified under the Communication of Start of Activity regime.

b) When the activity is sporadic or one-off.

In this case, the owner of the activity must process the fire report request directly through the Company Channel and prior to the presentation of the communication of commencement of activity and/or prior communication of works, minor works license.

The information on the documentation that must be attached, as well as the MB capacities of the documents and formats will be established on this channel and the interested person will be able to monitor the file from the authenticated space of Canal Empresa.

Case 2: Request for a prior fire report when the procedure is part of a major works license or activity license.

The request for the prior fire report will be processed by the City Council following the administrative procedure for the requested license.

Remember that technical documents must be electronically signed by the competent technician, endorsed by the professional association or certificate of professional performance or similar. Embedded electronic signatures or scanned manuscripts are not valid.
